This Privacy Policy explains how we collect, use, and disclose Personal Information when you use our developer assessment and job-matching platform (the "Services") or otherwise interact with us. 1. Scope and Applicability
This Privacy Policy applies to all individuals using our Services and websites, including:
- Service Users ("Customers" or "Clients"): individuals or entities purchasing or evaluating our services.
- Developer Job Applicants: candidates participating in NoFUD-led developer assessments seeking employment or contract opportunities through us or our customers.
- Non-developer Job Applicants: applicants who participate in alternative recruitment processes (e.g., resume screening, traditional interviews) where developer assessment is not utilized.
Where you are located in the European Economic Area (EEA), the United Kingdom (UK), or Switzerland, additional provisions in Section 7 (GDPR Notice for Service Users and Developer Job Applicants) and Section 8 (GDPR Notice for Non-developer Job Applicants) apply. We act as a data controller for non-developer job applicants and either a controller or processor (depending on the relationship) for developer job applicants and service users.
2. Personal Information We Collect
Personal Information is information that identifies, relates to, or can reasonably be linked with you. We collect Personal Information through:

- Profile information (e.g., work history, skills, certifications, location).
- Resume / CV details, if uploaded.
- Audio/visual data from interviews or coding assessments (e.g., webcam recordings).

- Information from Job Applications:
- Resume content, references, links to professional profiles (LinkedIn, GitHub).
- Demographic data (in some cases, if you voluntarily provide it).
- Information from Third-Party Providers:
- Service customers (e.g., hiring companies) may share certain candidate-related data.
- Single sign-on providers (e.g., Google, GitHub) that you use to authenticate.
- Information from Browsing the Services:
- Device data (e.g., IP address, browser type, operating system).
- Usage data (e.g., pages visited, time spent on pages).

3. How We Use Personal Information
We use Personal Information to:
- Provide the Services: e.g., facilitate developer assessments, match candidates with customer-employers, manage user accounts, schedule and conduct interviews, communicate with you, and otherwise operate our platform.
- Improve the Services: e.g., analyze usage patterns, troubleshoot issues, develop new features.
- Marketing & Promotional Activities: send updates, newsletters, and offers consistent with your preferences. You can opt out via the "unsubscribe" link or by emailing optout@NoFUD.com.
- Legal Obligations: comply with laws, court orders, or government requests; protect rights, safety, and security.
- Hiring Decisions (particularly relevant for non-developer applicants): review qualifications, schedule interviews, and consider applicants for available positions.
4. Disclosure of Personal Information
We may share Personal Information with:
- Service Providers: third-party vendors that perform services on our behalf (e.g., cloud hosting, analytics, payment processors). They are contractually bound to handle data securely and use it only for the specified purposes.
- Customers: when we facilitate a job match or developer assessment, we may share relevant candidate information with the customer/employer.
- Affiliates and Subsidiaries: within our corporate group, for consistent business operations.
- Business Transactions: if NoFUD is involved in a merger, acquisition, or sale of assets, your information may be transferred to the relevant parties (subject to confidentiality).
- Legal Compliance & Protection: to comply with applicable law, respond to lawful requests, or protect the rights, property, or safety of NoFUD, our users, or others.
We do not sell Personal Information for monetary consideration.
5. Data Retention
We retain Personal Information only as long as is necessary to:
- Provide the Services you requested.
- Comply with our legal obligations.
- Resolve disputes and enforce our agreements.
Once these purposes no longer require your data, we either delete or anonymize it. For job applicants whose applications are not selected, we may retain certain data for an additional period in case future opportunities arise (in line with applicable law), or we may delete it upon request.

7. GDPR Notice for Service Users and Developer Job Applicants
If you reside in the EEA, UK, or Switzerland, the following applies in addition to the rest of this Privacy Policy:
7.1 Data Controller
For Service Users (e.g., customer-employers) and Developer Job Applicants who use our developer assessment platform, NoFUD typically acts as a joint controller alongside the customer for processing data related to candidate evaluations and job matching. However, for some processing activities (e.g., user-account creation), NoFUD acts as the sole controller. 7.2 Legal Basis for Processing
We process Personal Information under one or more of the following legal bases:
- Contractual Necessity: e.g., to provide or improve the Services you have requested.

7.4 Data Transfers Outside the EEA

7.5 Data Retention (EEA-Specific)

8. GDPR Notice for Non-developer Job Applicants
If you are applying for a position via traditional means (e.g., resume submission, in-person interviews), and you reside in the EEA, UK, or Switzerland, the following supplemental notice applies:
8.1 Data Controller
NoFUD is the sole Data Controller for the Personal Information collected as part of your job application.
8.2 Categories of Data Collected

- Identification Documents (if relevant to the position or required by law).

We retain your data for the duration of the recruitment process. If you are not selected, we may keep your information for up to 24 months for future opportunities, unless you request earlier deletion or local law mandates a different retention period.

Same data subject rights as outlined in Section 7.3 above, including the right to access, rectify, erase, restrict, object, port, withdraw consent, and lodge a complaint.
8.6 Data Sharing
We may share your application data with third-party service providers (e.g., background check vendors) under strict confidentiality, and only as necessary.
8.7 Security and International Transfers
We implement reasonable security measures and rely on SCCs or other lawful mechanisms for international transfers where applicable.
9. Children's Privacy
The Services are not directed to children under the age of 13 (or other minimum age in your jurisdiction). We do not knowingly collect Personal Information from children under that age. If we become aware that a child has provided us with Personal Information, we will delete it as soon as possible.

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the revised version on our website and updating the "Last Updated" date. Your continued use of the Services after the changes take effect signifies acceptance of the revised Privacy Policy.
